These Terms & Conditions constitute a binding agreement between you and Ranch Resort Sport and Spa LLC (“Beyond the Fence,” “we,” “us,” or “our”) governing your use of the services available at beyondthefence.ranchresortbahamas.com, including all programs, video content, live classes, podcasts, and digital resources accessible through our platform (the “Service”).
BY USING OUR SERVICE, YOU AGREE TO BE BOUND BY THESE CONDITIONS. IF YOU DO NOT ACCEPT THESE CONDITIONS, DO NOT USE THE SERVICE. IF YOU ARE USING THE SERVICE ON BEHALF OF AN EMPLOYER, YOU REPRESENT THAT YOU HAVE AUTHORITY TO ACCEPT THESE CONDITIONS ON THEIR BEHALF.
Description of Service
Beyond the Fence is a digital wellness platform providing members with on-demand access to yoga, Pilates, equestrian lifestyle, and wellness content. Members may access online video classes at any time, participate in live-streamed sessions, engage with the Beyond the Fence community, receive member pricing on applicable products, and receive platform updates and promotional communications via email.
Eligibility
You must be 18 years of age or older to use the Service, or have the express consent of a parent or legal guardian. By using the Service, you represent and warrant that all information provided in your profile is accurate and that you are fully capable of complying with these Conditions.
Physical Activity & Health Disclaimer
Beyond the Fence provides wellness and fitness content for informational and entertainment purposes only. All content — including yoga, Pilates, and movement-based programming — is not a substitute for in-person instruction, professional medical advice, diagnosis, or treatment.
You assume full responsibility for any physical risk associated with participation in any exercise or movement program accessed through the Service. Always consult your physician or a qualified healthcare professional before beginning any new fitness regimen. Do not disregard professional medical advice based on anything accessed through this platform.
BY USING THE SERVICE, YOU VOLUNTARILY ASSUME ALL RISKS OF PHYSICAL INJURY, ILLNESS, OR HARM THAT MAY RESULT FROM PARTICIPATION IN ANY CONTENT ACCESSED THROUGH THE PLATFORM. RANCH RESORT SPORT AND SPA LLC SHALL NOT BE LIABLE FOR ANY INJURY OR HARM ARISING FROM YOUR USE OF THE SERVICE.
Account
To access the Service, you must create an account with accurate and complete information, which you agree to keep current. We reserve the right to suspend or terminate your account if we have reason to believe information provided is false or incomplete.
You are solely responsible for all activity occurring under your account. You must not share, transfer, sell, or disclose your login credentials to any other person. Excessive viewings or logins deemed fraudulent will result in immediate account termination without refund. Any unauthorized use of your account must be reported immediately to contact@ranchresortbahamas.com.
Account Sharing & Fraud Detection
Each subscription is for a single individual user only. Account sharing — defined as the use of one account by more than one person — is strictly prohibited and constitutes a material breach of these Conditions. Beyond the Fence actively monitors for concurrent logins, unusual geographic access patterns, and other indicators of account sharing. Upon detection, the account will be terminated immediately without notice and without refund.
License
Subject to these Conditions, Ranch Resort Sport and Spa LLC grants you a personal, non-exclusive, non-assignable, non-transferable, and revocable license to access the Service and use content made available through the platform solely for personal, non-commercial purposes.
You may not: (a) store, copy, modify, or distribute any content from the Service; (b) compile or collect Service content into any database or external work; (c) use automated tools to monitor, copy, or distribute Service content; (d) frame or embed the Service within any other website or application; (e) reproduce, sell, resell, or commercially exploit any part of the Service; (f) circumvent any digital rights management or security features; (g) threaten the integrity or availability of the Service; (h) remove or obscure any proprietary notices; or (i) include personally identifiable information about third parties without their consent.
Live Streaming
The Service may include live-streamed classes and events. By participating in any live session, you agree that: (a) sessions may be recorded and made available on-demand at Beyond the Fence’s discretion; (b) you will not record, rebroadcast, or redistribute any live session through any means; (c) you will conduct yourself respectfully and in accordance with these Conditions; and (d) access to live sessions may be revoked without notice for violations of these Conditions.
User Content
By submitting any content to the Service, you grant Ranch Resort Sport and Spa LLC a non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, adapt, publish, translate, distribute, and publicly display that content. You represent that you either created the content or have the rights to submit it.
Communications in public areas of the platform are not private. Exercise caution when sharing personal information in community spaces. Beyond the Fence reserves the right to remove any user content at any time, for any reason, without notice.
Licensed Content
Platform content, including instructor-led programming, is licensed to Ranch Resort Sport and Spa LLC under applicable intellectual property agreements. This content is provided for informational and wellness purposes only and does not constitute medical, therapeutic, or professional advice. Opinions expressed by instructors or contributors are their own and do not represent the views of Beyond the Fence or Ranch Resort Sport and Spa LLC.
Copyright & Intellectual Property
Beyond the Fence and Ranch Resort Sport and Spa LLC retain all intellectual property rights to the Service and its content, including videos, text, photographs, logos, music, audio, visual interfaces, and online programs. All unauthorized use is strictly prohibited.
We respect the intellectual property rights of content creators and expect the same from our members. Accounts that repeatedly infringe on third-party copyrights will be terminated.
Service Fees & Billing
Beyond the Fence uses Stripe as its third-party payment processor. By subscribing, you authorize Stripe to charge your payment method on a recurring basis in accordance with the plan you select. Your use of the Service is subject to Stripe’s Terms of Service and Privacy Policy in addition to these Conditions. Beyond the Fence is not responsible for errors made by Stripe.
Membership fees are charged at the beginning of each billing cycle. We reserve the right to adjust billing schedules if a payment method cannot be successfully charged.
Subscription Plans
Monthly Subscription: Access to all platform content billed monthly at the then-current rate.
Lifetime Access: A one-time payment granting permanent access to the platform at the then-current lifetime rate, subject to the platform remaining in operation and these Conditions.
No Refunds
All payments are final and non-refundable. There are no credits for partially used subscription periods. Upon cancellation, you will retain access to the Service until the end of your current billing cycle, after which access will be terminated.
Cancellation
You may cancel your membership at any time for any reason by accessing the billing section of your account profile. Cancellation takes effect at the end of the current billing period. Lifetime access holders may not cancel or request refunds once purchase is complete.
Privacy
Beyond the Fence collects registration and usage information in accordance with our Privacy Policy, which is incorporated into these Conditions by reference. By using the Service, you consent to our data collection and use practices as described in the Privacy Policy.
Consent to Electronic Communications
By using the Service, you consent to receive electronic communications from Beyond the Fence, including account notices and promotional emails. You agree that electronic communications satisfy all legal requirements for written communications. You are solely responsible for any data, SMS, or telecommunications charges incurred through use of the Service.
Third-Party Content & Links
The Service may include links to third-party websites or content. Beyond the Fence does not monitor or control third-party content and assumes no responsibility for its accuracy or availability. These Conditions do not govern your use of third-party services. Access third-party content at your own risk.
Disclaimer of Warranties
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. RANCH RESORT SPORT AND SPA LLC, ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BEYOND THE FENCE DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM USE OF THE SERVICE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANCH RESORT SPORT AND SPA LLC AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BEYOND THE FENCE’S TOTAL LIABILITY EXCEED THE GREATER OF: THE TOTAL FEES PAID BY YOU IN THE TWO MONTHS PRECEDING THE CLAIM; OR USD $40.
Indemnification
You agree to defend and indemnify Ranch Resort Sport and Spa LLC, its affiliates, directors, officers, agents, employees, suppliers, and distributors from and against any costs, damages, expenses, and liabilities caused by your use of the Service, your violation of these Conditions, or your infringement of any third-party rights.
Governing Law & Jurisdiction
These Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. You agree that any legal proceedings arising from or related to these Conditions or the Service shall be brought exclusively in the courts of the State of Delaware, and you hereby consent to such jurisdiction.
Modifications to These Conditions
We reserve the right to modify these Conditions at any time. Changes will be posted to the platform under the Terms & Conditions section. It is your responsibility to review these Conditions periodically. Continued use of the Service after any modification constitutes your acceptance of the updated Conditions.
Termination
You may terminate your use of the Service at any time by closing your account. Beyond the Fence may suspend or terminate your access at any time for any reason, including violation of these Conditions. Upon termination, your rights under these Conditions will cease immediately. You remain responsible for all obligations incurred prior to termination.
Entire Agreement
These Conditions constitute the entire agreement between you and Ranch Resort Sport and Spa LLC regarding your use of the Service and supersede all prior agreements and understandings.
